AmazonBasics Two-Year Limited Warranty

This Limited warranty is provided by Amazon EU Sàrl of 5 Rue Plaetis, L-2338 Luxembourg, Grand- Duchy of Luxembourg (Lux. reg. n° B 101818, Share capital: €37500, Trading authorisation n° 104408) to you as the purchaser of the AmazonBasics branded product(s) (the "Product") from Amazon EU Sàrl, for the Product.

If you are a consumer, the rights provided to you under this limited warranty are provided alongside and in addition to all rights and remedies conveyed to you by consumer protection laws and regulations and do not affect your legal rights applicable to consumers in your country. Should the Product be defective or if it does not conform with the Conditions of Use and Sale, you can choose to make a claim under consumer law or this limited warranty.

We warrant the Product to you against defects in materials and workmanship under ordinary consumer use on delivery and for a period of 24 months from the date of delivery. If the Product is a consumable product (for example, an ink cartridge), this limited warranty will expire with respect to the Product as soon as the consumable part of the Product (for example, the ink) has been partly or totally consumed.

In addition to your statutory consumer rights, we warrant the Product to you against defects in materials and workmanship under ordinary consumer use on delivery and for a period of 12 months from the date of delivery. If the Product is a consumable product (for example, an ink cartridge), this limited warranty will expire with respect to the Product as soon as the consumable part of the Product (for example, the ink) has been partly or totally consumed.

If the Product proves defective during the 12-month warranty period, and you wish to use this limited warranty, we will ask you to follow the instructions for returning the Product that we will provide you, and we will take one of the following actions: (i) replace the Product with a product that is the same or equivalent to the Product you purchased; (ii) repair the Product; or (iii) refund to you the whole of or part of the purchase price of the Product. Due to technological advances and Product availability, the replacement Product may differ slightly and may have a lower selling price from the original Product you purchased. We will provide you with a free returns label to return the Product or, at our option, reimburse your reasonable costs of returning the Product.

Replacement and repaired Products or parts provided under this limited warranty will only be shipped to addresses within the European Union and to addresses within countries of the European Free Trade Association where the Product is available for sale to customers in such countries. This limited warranty applies to any replacement Product or part, or to any repair, for the remainder of the original warranty period or for 90 days from its shipment to you, whichever period is longer. All parts and Products you return to us and for which we give you a refund or replacement will become our property. Failure to ship the damaged Product back to us may result in your being charged for the replacement Product at full retail price.

This limited warranty applies only within the European Union and within countries of the European Free Trade Association where the Products are available for sale to customers located in such countries. This limited warranty will not apply to any defect in the Product arising from fair wear and tear, accident, misuse, negligence by you or any third party, fire or other external causes, alterations or repair, commercial or business use, or use of the Product in a way we do not recommend in any instruction manual, terms of use or similar document.

The Conditions of Use and Sale for the Amazon website from which you purchased the Product are incorporated into this limited warranty by reference, including without limitation the limitations of liability. In the case of any inconsistencies between the Conditions of Use and Sale and this limited warranty, this limited warranty will prevail.

We are not liable for losses resulting from any breach of warranty or other breach of contractual duties unless otherwise specified below. Nothing in this limited warranty excludes or limits our liability for: (a) losses that are a foreseeable consequence of our breach of warranty or other breach of contractual duties; (b) death or personal injury caused by our act or omission; and (c) losses arising from our fraud. Nothing in this limited warranty will reduce your statutory rights relating to faulty or misdescribed goods. Nothing in this limited warranty excludes or limits our liability for:

(a) losses that are a foreseeable consequence of our breach of warranty or other breach of contractual duties;

(b) death or personal injury caused by our act or omission;

(c) wilful misconduct or gross negligence and

(d) losses arising from our fraud.

We will be liable for damages caused by or relating to fault or mis-described goods, and we cannot limit our liability in those circumstances. SPECIFIC PROVISIONS FOR CONSUMERS IN FRANCE

Amazon as the supplier remains liable for the statutory warranties under French Law, including the legal warranty against hidden defects in accordance with Articles 1641 to 1648 and 2232 of the French Civil Code, and the application of the legal warranty of conformity in accordance with Articles L.217-4 to L.217-12 of the French Consumer Code.

When acting on the grounds of the legal guarantee of conformity, the consumer may:

- benefit from a two year period from the delivery of the product in which to act;

- choose between the repair or the replacement of the product, subject to the conditions regarding costs provided for by Article L. 217-9 of the French Consumer Code;

- is exempt from having to prove the lack of conformity of the product for the two years following its delivery (and for six months following the delivery of the product, for second-hand goods).

The legal guarantee of conformity applies regardless of the one-year limited warranty offered.

Additionally, the consumer can decide to apply the legal guarantee for hidden defects within the meaning of Article 1641 of the French Civil Code. In such a case, the consumer can choose between the cancellation of the sale or a reduction of the sale price, pursuant to Article 1644 of the French Civil Code.

Article L. 217-4 of the French Consumer Code

The seller shall deliver a good in conformity with the contract and shall be held liable for the lack of conformity existing at the time of delivery. The seller shall also be held liable for the lack of conformity stemming from the packaging, the fitting instructions or the installation when such installation is the responsibility of the seller pursuant to the contract or has been conducted under the seller's supervision.

Article L. 217-5 of the French Consumer Code

The good shall be deemed in conformity with the contract:

1. If it is fit for the use usually expected from a similar good and, where appropriate:

  • it matches the description given by the seller and has the qualities that such seller presented to the buyer by means of a sample or model; and
  • if it presents the qualities that a buyer can legitimately expect given the public statements made by the seller, the manufacturer or its representative, in particular in the advertising or the labelling; or

2. if it presents the characteristics mutually agreed upon by the parties or is fit for any special use intended by the buyer, made known to the seller and which the latter agreed to.

Article L. 217-12 of the French Consumer Code

The action resulting from the lack of conformity shall lapse two years after the delivery of the goods.

Article L. 217-16 of the French Consumer Code

During the effective period of the commercial warranty offered to a buyer at the time of acquisition or repair of a tangible asset, if the buyer requires from the seller a repair covered by the warranty, any period of seven days or more during which the goods are out of use for repair shall be added to the remaining term of the warranty. Such period shall run from the request for intervention made by the buyer or from the date when the said good is made available for repair, if this date is after the request for intervention.

Article 1641 of the French Civil Code

The seller shall guarantee the sold good for hidden defects which make it unfit for its intended use, or which diminish this use to such an extent that the buyer would not have bought it, or would only have accepted to buy it for a lesser price, had he been aware of such defects.

Article 1648 § 1 of the French Civil Code

The action resulting from hidden defects has to be filed within two years of the discovery of the defect.

Without affecting your legal rights set out above, the one-year limited commercial warranty period will be extended by at least seven days to account for any repair period in which you could not use the Product.

SPECIFIC PROVISIONS FOR CONSUMERS IN GERMANY

In Germany, the relevant statutory rights are contained in sec. 434 et. seqq., 474 et seqq. German Civil Code (Bürgerliches Gesetzbuch) and apply from the time when the risk passes ("bei Gefahrübergang").

SPECIFIC PROVISIONS FOR CONSUMERS IN ITALY

Under Italian law, your statutory warranty lasts for two years from the date of delivery, and you may exercise your rights under the statutory warranty in relation to a defect discovered at any stage during the two year statutory warranty period, provided that you notify Amazon of the relevant defect within two months of discovery.

SPECIFIC PROVISIONS FOR CONSUMERS IN SPAIN

Under Spanish law, your consumer rights in the event of lack of conformity of the Product or under a statutory warranty can be exercised for two years from the date of purchase. This limited warranty does not affect your exercise of any consumer rights.
